1. Introduction

Kains Agency (“Company,” “we,” “us,” or “our”) operates an e-commerce platform that offers wholesale ginger, garlic, crushed garlic, ground ginger, bicycles, bicycle spares and accessories, and purified water. By using our website, you accept these Terms and Conditions in full.

2. User Eligibility

  • You must be 18 years or older to use this website.

  • By registering an account, you confirm that the information provided is accurate and up to date.

  • We reserve the right to suspend or terminate accounts if fraudulent or misleading information is provided.

3. Orders and Payments

  • All orders placed through our website are subject to acceptance and availability.

  • Prices are listed in ZAR (South African Rand) and are subject to change without prior notice.

  • Accepted payment methods include EFT, credit/debit cards, and other payment gateways as listed on our website.

  • Full payment must be received before order processing and shipment.

4. Shipping and Delivery

  • We deliver across select locations in South Africa.

  • Shipping costs and estimated delivery times will be displayed during checkout. Major Cities are generally 2-3 working days. 

  • We are not responsible for delays due to courier services, weather, or other unforeseen circumstances.

  • If an order is undeliverable due to incorrect details provided by the customer, additional shipping fees may apply.

  • Ice-Cream orders will be a click and collect from the store. This will be shown when checking out on Ice-Cream orders. 

5. Returns, Refunds, and Cancellations

  • In line with the Consumer Protection Act No. 68 of 2008, Kains Agency is committed to fair and transparent dealings with all our customers. You are entitled to the following rights regarding returns and refunds:

    1. Right to Return Defective or Unsafe Goods

    If the goods you receive are defective, damaged, or unsafe:

    • You have the right to return the item within 10 business days of delivery.

    • You may request a replacement, repair, or a full refund.

    • The product must be unused, in its original packaging, and accompanied by proof of purchase.

    2. Incorrect or Misrepresented Products

    If the product delivered is not what was ordered, or differs substantially from what was advertised:

    • You may return the item within 10 business days for a full refund, exchange, or credit.

    • Kains Agency will cover all return shipping costs in such cases.

    3. Cooling-Off Period for Direct Marketing

    If you purchased through direct marketing:

    • You may cancel the transaction within 5 business days from the date of delivery, as per the CPA.

    • A full refund will be processed within 15 business days after receiving the returned goods.

    4. Refunds Processing

    • Refunds are issued via the original payment method used.

    • Once approved, refunds are processed within 14 business days.

    • Shipping fees may not be refundable unless the return is due to our error or defective products.

    5. Exclusions

    • We do not accept returns on perishable goods (e.g., fresh garlic or ginger), unless they are defective or spoiled on delivery.

    • Refunds will not be granted for goods that have been used, altered, or damaged after delivery.

  • Kains Agency is not liable for any indirect, incidental, or consequential damages arising from the use of our products or website.

  • We do not guarantee that our website will be error-free or uninterrupted.

  • Disputes will first be attempted to be resolved through negotiation. If unresolved, they may be escalated to legal proceedings in Durban.
